Cannabis/Marijuana Laws
Cannabis & Marijuana Offenses in Florida
Florida’s marijuana laws continue to evolve, particularly with the expansion of the state’s medical marijuana program. However, marijuana remains illegal under Florida law for recreational use, and many cannabis-related offenses still carry serious criminal penalties. Charges involving possession, cultivation, trafficking, distribution, or operating a grow house can result in misdemeanor or felony convictions, substantial fines, probation, driver’s license consequences, and potential prison sentences.
At Coplan-Gardner & Gardner, P.A., Darin Gardner provides strategic criminal defense representation for individuals and businesses facing marijuana-related charges throughout Northeast Florida. As a former prosecutor with extensive felony trial experience, he understands how these cases are investigated and prosecuted and works to identify weaknesses in the State’s evidence from the beginning of the case.
Marijuana Possession Charges in Florida
Under current Florida law, possession of marijuana without valid authorization under Florida’s medical marijuana laws remains a criminal offense.
Possession of 20 grams or less of cannabis is generally charged as a first-degree misdemeanor, punishable by:
- Up to 1 year in jail
- Up to 12 months of probation
- A fine of up to $1,000
Possession of more than 20 grams is typically charged as a third-degree felony, punishable by:
- Up to 5 years in prison
- Up to 5 years of probation
- A fine of up to $5,000
Additional charges may apply if law enforcement alleges intent to sell, distribute, manufacture, or traffic cannabis products.
Marijuana Trafficking and Distribution Offenses
Florida aggressively prosecutes marijuana trafficking and distribution offenses. Trafficking charges are generally based on the weight of the cannabis involved and can trigger mandatory minimum prison sentences and significant fines.
Law enforcement agencies frequently use confidential informants, controlled purchases, search warrants, surveillance operations, digital evidence, financial records, and undercover investigations in these cases. Whether the allegations involve possession with intent to sell, interstate transportation, cultivation operations, or large-scale trafficking accusations, having experienced legal representation early in the investigation is critical.
Cannabis Cultivation and Grow House Charges
Unlike some states, Florida law does not generally permit individuals to cultivate marijuana plants for personal recreational use. Unauthorized cultivation or operation of a grow house can result in serious felony charges.
Cannabis cultivation investigations often involve allegations related to:
- Operating a grow house
- Cultivating marijuana plants
- Leasing or owning property used for cultivation
- Manufacturing cannabis products
- Possession of cultivation equipment or related materials
These investigations can become complex quickly and may involve search and seizure issues, warrant challenges, financial investigations, and disputes regarding ownership or control of the property.
Medical Marijuana Laws in Florida
Florida allows qualified patients to legally obtain medical marijuana through the state’s Medical Marijuana Use Registry. However, strict regulations govern who may legally possess and use medical marijuana and how it may be dispensed.
To qualify for medical marijuana in Florida, an individual generally must:
- Be a Florida permanent or seasonal resident
- Have a qualifying medical condition diagnosed by a qualified physician
- Be entered into the Medical Marijuana Use Registry
- Obtain a valid Medical Marijuana Use Registry Identification Card
Only licensed Medical Marijuana Treatment Centers (MMTCs) are authorized under Florida law to cultivate, process, and dispense medical marijuana products.
